I currently have a spa located next to hair salon with landlord related to hair salon owner.  I have had some troubling issues with the landlord.  For one I have had problems with the temperature within the spa.  At first it started with summer heat and not enough cool air to keep temperature at comfort level so I purchased fans to circulate.  I brought this issue to the landlord's attention with little to none response.  Now that we have been in extreme cold temperatures again I have issues with not enough heat.  So I had a wall heater installed to help along with addressing issue with landlord.  The building I share with two other businesses have just one heating and cooling unit.  The hair salon has the main control for my spa and other business.  Since the hair salon has large windows across the front a lot of heat is generated for the main control which by the way regulates overall temperatures.  This means the main heat hardly ever comes on making my shop "COLD" in fact with the wall heater and additional space heater's the average temperature is 50-57 degrees.  Again I brought this to the attention of the landlord.  I was told "that I were cold I should put on more clothes".  I have addressed this issue with the hair salon owner and her suggestion was to keep the door open between the two shops.  Okay, first the hair shop has crazy smells with hair treatment and nail treatments not to mention the noise.  I've even had customer's say they were not coming back because it was too cold and too noisy have this on record.  Frustrated to say the least.  I have invested a lot of money putting this shop together.  Any suggestion's?

I am assuming you have a written lease?  If so, make sure you start documenting everything. Send letters, certified mails when you have a complaint, and then see about getting out of the lease. You may be able to do it by agreement, if so, make sure you confirm everything in writing.

Yes there is a signed contract in fact when I paid March rent the landlord stated she was surprised I paid for another month's rent.  Stated she should come in to get a treatment before I leave.  What??? Talk about unprofessional.  Maybe she can pay me for the business I lost because of this issue and for relocation of the spa?

Is there not a thermostat or central air in the building?

Yes, within the hair salon.  The Spa Business and another store on the other side of hair salon we all share the same thermostat the same central air.  The original building was a bowling alley which the current owner turned into various stores.  1. My Spa, 2. Hair Salon, 3. Liquor Store.  The Spa is separated by a wall and one door.  The door has to stay shut because of the fumes and the noise.  When the girls in the hair salon get too hot they shut the air down making my store ice cold.  I have installed a wall heater and several space heaters and the best I can get is below 60 degrees. I have expressed my concerns to both landlord and hair salon owner.  Just get dirty looks and told to put more clothes on if I'm cold.   I don't see how that helps the client during a body scrub or a body wrap or anything else for that matter.  Not sure how to handle this just tired of making excuses.  I've lost a lot of business because of the temperature I even have this in writing from clients when I sent out survey's.

 

hmmm - I don't know too much about commercial leases...but if they are supposed to be seperate spaces with seperate tenants aren't there local regulations about heat/cooling, water, and electricity?

I suspect some serious buiding code violation may exist.

I guess you need to decide how much you are willing to put up with to stay in your space and go from there.

What does your lease say about heating & cooling. She may have to put in somethings separate. You need to check with your city/state to see what they require for separate businesses, etc. Im sure there are minimum requirements, i.e. runnung water, bathroims, heating and cooling, etc.

Where are you located?

Small town MO.  I have made a decision to not renew my contract.  Sad because now I have to pay out for transfer of information, set up shop somewhere else.

In my opinion, go through your lease once. If it says anything about providing heat, then don't hold back. If lease stipulates use of Heating and all, then without any doubt ask your landlord about it. You have all rights regarding that.
