I have job offer to work in a medical spa but they want me to sign non compete agreement.

I have plan to start my own small place later after saving some money.I dont want to get in a legal trouble  if i want to go my own and start my skin care place.

The spa is offering Laser Hair removal,Microderm,Chem peels facials and non invasive agressive treatments.

PLEASE share cuz i dont want to lose the job but don't want to stuck for long time with them and can't work for other spa or my own for 2 years.

I want all your feed back how to deal with that?

well if you take the job with the medi spa they will require you to sign non compete.  If and when you go out on your own, sadly, you will have to start from scratch.  Spas DO sue, and they DO win.  I've seen it happen too many times to count.  Don't try to be sneaky, there typically is just no way around a non compete.  Perhaps you'll really enjoy working there and make good enough money to stay for awhile, or at least until the time frame of non compete runs out.  Make sure you know for certain the time frame, by the way.  

The thing they are trying to prevent is you running off with their(your) clients. Does the non compete have a location radius saying you cannot work within 2 miles or 10 Miles of their spa location? I would want to ad that into the clause and negotiate the smallest radius they will agree to. Also, some companies will give you a bonus if you sign a non-compete. My husband got a $1000 bonus for signing his non compete and the time frame was only 6 months. After he left the company, he worked a couple of odd jobs for those six months, then went directly to a competitor. Some companies will pursue legal action against you if you break your agreement. The company my husband worked for did just that with a few of his coworkers so we knew not to try and test them. Negotiate for the shortest amount of non compete time frame. They have to understand that people need to eat and earn a living! If they really want you they will be willing to be flexible.

I have had my own skin care center for the past 20 years. I was told by an attorney that If you are an employee, the owner of the medical center or skin care center cannot pursue any legal action against you if you open your business close to them, however; if you are a partner or you are selling your skin care center to someone, then they can pursue.

The wisest thing for you to do is to see an attorney and pay couple of hundred dollars for your peace of mind. If you really like to get this job, its worth it. I think that Laws keep changing and it's hard to keep up with them.  No matter how much experience we all might have in this field, we should not be giving you legal advice.

U will be held to what ever you agree to when you sign the contract so read it and make sure you are willing to abide by it
