State Board Of Barbering & Cosmetology (Filing an Appeal).

For California Estheticians:

Has anyone gone through the appeal process with Barbercosmo?  State inspector came for the random inspection and the esthetician who rents her room from me had 2 violations 

1. Towels not being stored in the closed cabinets

    *(The Esthy wasn't working in her room that day, massage therapist thought she was doing a nice thing by putting the Esthy's towels, folded in her room. Massage Therapist are not governed by the Stateboard so she doesn't know the rules and regulations.

2. Treatment table not clean ( because the "clean folded" towels that were put on her treatment bed by the kind massage therapist).

So guess who get's to pay for the citation?? Me..the owner of the establishment.  Also I get the "ding" on my record and if the Esthy was there that day, she would get a ding as well.  I have been in this business for 15 yrs with a golden record....until this.

So I am wondering if anyone has filed any appeals and if the DRC is in Sacramento?  When I call I am put on hold for a very long time.  

Also..I've learned a lot about rules and regulations in the past 2 weeks of my research. So there are some things I've dropped off my menu.

Welcome to government run amok....clean towels on a treatment table = unclean treatment table.

CA is so broke, they see regulation enforcement as a way to replenish state coffers. After all, we greedy business owners can afford it.

I was thinking the same thing about CA being broke and having no mercy. Oh well the check is in the mail... :(

I am not in your state but filing an appeal can't hurt- unless it's easier to simply pay fine and spend time implementing checklists that your IC and employees must follow- cant hurt to say if they are in charge of room they are in charge of fine to keep the on toes for next time you get inspected .

I know towels are to be in closed cabby but awful strict if they were setting room- I would try to appeal - your table was sprayed and clean and towels were folded to lay on table for bed set up..

What did you take off menu?

I am so sorry to hear about your citation. Who would have thought clean towels on the table could lead to a violation. What items have you taken off your menu? do you plan on adding them back? 

I removed lash and brow tinting as it is only allowed to be performed by a cosmetologist and the product the Cosmo is using has to be approved by board.

You should also make sure your workers are being treated/classified properly.

Don't be surprised of other government agencies -- BOL, especially -- pick up your scent.  They are BRUTAL and have shut down many a salon with their draconian approach

I have all renter's that have contracts and got all that in order.  The esthetician who rents from me is also a licensed Cosmetologist. Trust me...we are making sure all of our ducks are in order. :)

Excuse my language, but what is wrong with these @$$holes?!?!?!  Don't they have a nasty nail shop to harass somewhere nearby?  Clean.  Effin.  Towels.

Thanks Christine!!  The inspector was a nice guy I have to say. When he came in I was in the middle of a treatment with a client and he didn't want to take up too much of my time which I appreciated. He told me that A LOT of fines are found in Nail only salons and spa's using lancet's, skin tag removers ect..  I just chalk it up a learning experience.  I was reading that some of these fines can run from $100-$1,000's of dollars so I suppose my $200 isn't that bad :)   The Esthy and I are splitting the fee so that's nice.

Sorry to hear about this.  I think it's in the back of my mind and many other Estheticians.  I heard that inspectors are not allowed to open closed cabinets or enter treatment rooms when the door is closed.  Do you know if this is correct?

If I was in your position I would try to appeal it.  Wouldn't be good to have this on your record.
